Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and 34 Ventures ("Company," "we," "us," or "our"), governing your use of the Get Real IP service ("Service") available at getrealip.net.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

Get Real IP provides dedicated static public IP addresses routed to your network via encrypted VPN tunnels. The Service includes:

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. You may not share, sell, or transfer your account to another person or entity.

You must notify us immediately if you believe your account has been compromised.

4. Subscription and Billing

4.1 Recurring Billing

The Service is provided on a monthly subscription basis. Your subscription renews automatically on your billing date each month unless you cancel. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.2 Pricing

Current pricing is published on our website. We may change pricing at any time. Price changes will take effect at your next billing cycle.

4.3 Payment

Payment is due at the time of subscription and at each renewal. If your payment method fails, your service may be suspended. We are not responsible for any fees charged by your bank or payment provider. You remain responsible for any outstanding balance if we are unable to charge your payment method.

4.4 Adding Services

When you add a tunnel or additional IP address mid-cycle, you will be charged immediately for the prorated amount covering the remainder of your current billing period. The addition will only be provisioned if payment succeeds.

4.5 Cancellation

You may cancel individual IP addresses or your entire subscription at any time through the dashboard. Cancelled services remain active until the end of your current billing period. No refunds are issued for partial billing periods.

4.6 Reactivation

If you reactivate a cancelled or expired IP address after your billing date has passed, you will be charged for the full current billing cycle.

You may not use the Service to:

Port 25 (SMTP) is blocked by default on all IP addresses. You may request an exception by contacting us. Exceptions are granted at our sole discretion based on demonstrated need. Attempting to circumvent the port 25 block is a violation of these Terms.

6. Abuse Complaints

As the holder of the IP address space, we receive abuse complaints from third parties. When we receive a complaint regarding your assigned IP address, we will forward it to you. You must respond and take appropriate corrective action within 24 hours.

Failure to respond to abuse complaints, or repeated complaints, may result in suspension or termination of your service.

We reserve the right to immediately suspend service without prior notice in cases involving CSAM, active network attacks, or spam origination.

7. IP Addresses

IP addresses assigned to you are provided as part of the Service. You do not own the IP addresses. Upon cancellation or expiry of your subscription, your IP addresses are deactivated and may be reassigned. There is no guarantee that you will receive the same IP address if you re-subscribe after a lapse in service.

Reverse DNS (PTR) records may be set through the dashboard. PTR records must pass forward DNS validation. PTR records are removed when the associated IP address is deactivated.

8. Logging and Privacy

Get Real IP is not a privacy or anonymity service. We log:

9. DMCA and Copyright

We respond to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act. If we receive a DMCA notice regarding content accessible through your assigned IP address, we will forward it to you. You are responsible for responding appropriately.

Repeated copyright infringement may result in termination of your service.

10. Service Availability

We make reasonable efforts to maintain the availability of the Service but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control.

We will make reasonable efforts to provide advance notice of planned maintenance that may affect your service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, the Company's total liability to you for any claims arising out of or relating to these Terms or the Service is limited to the amount you paid for the Service during the current billing period.

The Company is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or any third-party claims related to content or activity associated with your assigned IP addresses.

14. Termination

14.1 By You

You may cancel your subscription at any time through the dashboard.

14.2 By Us

We may suspend or terminate your service at any time if you violate these Terms. For non-critical violations, we will make reasonable efforts to notify you and provide an opportunity to cure the violation. For violations involving CSAM, active attacks, or spam, we may suspend immediately without notice.

14.3 Effect of Termination

Upon termination, your IP addresses and tunnels are deactivated. We are not obligated to provide refunds for termination due to your violation of these Terms.

15. Export Control

You represent that you are not located in, under the control of, or a national or resident of any country subject to United States trade sanctions, and that you are not on any U.S. government restricted party list. You may not use the Service in violation of U.S. export control laws or sanctions regulations.

16. Dispute Resolution

16.1 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration, rather than in court. Arbitration shall be conducted in Howard County, Maryland under the rules of the American Arbitration Association.

16.2 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16.3 Small Claims Exception

Either party may bring an individual action in small claims court in Howard County, Maryland if the claim falls within that court's jurisdiction.

16.4 Other Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

17. Modifications

We may modify these Terms at any time. We will make reasonable efforts to notify you of material changes. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

18. General

Governing Law. These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Survival. Sections 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), 15 (Export Control), and 16 (Dispute Resolution) survive any termination or expiration of these Terms.
